A. Introduction

Key Definitions:
- “AxePoint”, “we”, “us”, and “our” means AxePoint Law and its agents, employees, and representatives.
- “Personal Data” means any information relating to an identified or identifiable natural person who accesses the Site or whose information is entered into any content section on the Site.
- For purposes of this Policy, “processing” means collecting, recording, organizing, structuring, storing, adapting, altering, using, disclosing, or otherwise making available, and deleting Personal Data provided to us through the Site.

B. Personal Data We Collect
Users provide AxePoint with most of the Personal Data we collect. We collect the following types of data:
- Personal Identification Information You Give Us: We collect Personal Data such as your name, email address, username, password, demographic information (such as your gender and occupation), and other information you directly give us through the Site.
- Information We Get from Others: We may collect information gathered from third-party sites or sources you accessed, such as but not limited to Instagram, Facebook, Google, or LinkedIn. Any third-party information may be combined with the information received directly from you. Some third-party sites or sources may also provide us with information from your accounts to enhance and personalize your use of our Site. You have the right to modify your privacy settings on your device, browser, or on the third-party sites and right to refuse to provide certain information or receive interest-based advertisements on those third-party sites directly on the respective third-party site.
- Passive Information Collected: When you visit our Site, we automatically collect usage data and computer operating information such as the operating system type, cookies, web beacons, browser type, browser language, the Site you visited before browsing to our Site, pages you viewed, how long you spent on a page, access times, Internet protocol (IP) address, and other information about your use of and actions on our Site to customize your visit through technical means. C. How We Will Use Your Personal Data
Personal Data submitted to us through our Site will be used for the purposes specified in this policy or as provided for on the Site. AxePoint collects the Personal Data of users so that we can:
- Improve customer service: Information you provide helps us respond to your customer service requests and support your needs more efficiently.

We will not, without your express consent, supply your Personal Data to any third party for their or any other third party’s direct marketing. We do not sell, trade, or rent userss Personal Data to others. If you provide consent, we will share information you provide to third party service providers for the sole use of the third-party service providers helping us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys.

Although AxePoint will ordinarily only share your Personal Data pursuant to your request or consent, AxePoint expressly reserve the right to release any Personal Data pursuant to the following circumstances: (a) when required by law or legal process, (b) to investigate and/or take action against illegal activity, suspected abuse, or unauthorized use of our services, and (c) to protect the property or safety of our users or others.

Choices About Use and Disclosure of Your Personal Data

This opt-out does not apply to information provided to us as a result of a product purchase, Software purchase, or other transactions with us.
D. How We Store and Retain Your Data
Our data retention policies and procedures are designed to ensure that we comply with our legal obligations regarding the retention and deletion of Personal Data in accordance with all applicable state, federal, and international laws and regulations.
AxePoint does not keep any Personal Data for longer than is necessary to carry out the purpose or purposes for which the Personal Data was collected. Users may request AxePoint to delete their Personal Data or request an accounting of all Personal Data of theirs kept by AxePoint by sending an email to info@axepoint.com. AxePoint will respond within five (5) business days to any such requests. Notwithstanding the other provisions of this Section D, we will retain documents (including electronic documents) containing Personal Data:
- To the extent that we are required to do so by law;
- If we believe that the documents may be relevant to any ongoing or prospective legal proceedings; and/or
- To establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).
E. Security Measures
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information.
You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.
If a data breach occurs: If we determine that any user’s Personal Data has been accessed without authorization, AxePoint will report any confirmed or suspected situation to necessary parties immediately upon discovery, both orally and in writing, within 72 hours. If AxePoint reasonably believes a breach has or may have occurred, AxePoint will release a report to all users identifying:
- The nature of the unauthorized access, use, or disclosure;
- The nonpublic information accessed, used or disclosed;
- The person(s) who accessed, used, disclosed, and/or received nonpublic information (if known);
- What AxePoint has done or will do to mitigate any deleterious effect of the unauthorized access, use, or disclosure; and
- What corrective action AxePoint has taken or will take to prevent future unauthorized access, use, or disclosure.
In the event of a suspected breach, AxePoint will keep stakeholders informed regularly of the progress of its investigation until the uncertainty is resolved. To the extent possible, we will also facilitate the process to warn the victims of the theft so that they can protect their identity.
F. International Data Transfers
The Site is hosted in the United States, and all or a portion of the Site may also be hosted on the “cloud”, or other similar distributed hosting platform. If you are accessing the Site from the European Union, Asia, or any other region with laws governing Personal Data collection, use, and disclosure that differ from United States laws, note that you are transferring your Personal Data to a jurisdiction that does not have the same data protection laws as your home jurisdiction. By providing your Personal Data you consent to:
- our use of your Personal Data for the uses identified in this Privacy Policy, and
- the transfer of your Personal Data to the United States.
Under the General Data Protection Regulation (GDPR), if you have provided consent for the processing of your Personal Data, you have the right to withdraw consent at any time, which will not affect the lawfulness of the processing before your consent was withdrawn. You have the right to request access to and rectification or erasure of your personal information, as well as the right to restrict processing, object to processing, and under certain circumstances the right to data portability. AxePoint will be completely transparent in how we use Personal Data and users have the right to know exactly what information is held about them and how it is processed.
California Residents:
If you are a California resident, California Civil Code Section 1798.83 permits you to request free of charge information regarding the disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes. AxePoint does not and will not share Personal Data with third parties for their own direct marketing purposes.
G. Personal Data Rights for Certain Users
There are state and international laws which provide their residents and citizens with additional rights regarding our use of their Personal Data. This section is to discuss those rights and your options to exercise such rights if they apply to you.
Users in the European Union, California, Colorado, Connecticut, Virginia, Florida, Montana, Oregon, Kentucky, New Jersey, Nebraska, New Hampshire, Tennessee, Iowa, and Utah each are provided with the general rights to:
- Right to Access: Right to request AxePoint for copies of their Personal Data. AxePoint may charge you a small fee for this service. For users residing in California, this right also includes the ability to request all Personal Data AxePoint has obtained relating to the User in the 12 months prior to the request and to have information on who the information was shared with and how it was shared, if at all.
- Right to Rectification: Right to request that AxePoint correct any information in our possession or control which they believe is inaccurate. This also includes the right to request that AxePoint complete any information in our possession or control which they believe is incomplete.
- Right to Erasure: Right to request that AxePoint erase their Personal Data, under certain conditions.
- Right to Restrict or Object to Processing: Right to request that AxePoint restrict and/or object to the processing of their Personal Data for targeted advertising and sales, under certain conditions.
- Right to Object to Profiling: Right to opt-out of any profiling through the processing of Personal Data being performed and to opt-out of any profiling being shared or sold to third parties.
- Right to Data Portability: Users in the European Union (or locations where the General Data Protection Regulation is enforced) have the right to request that AxePoint transfer their Personal Data to another organization or directly to the particular European user, under certain conditions.
To make a request to exercise any of the above rights, you must submit the request in writing to info@axepoint.com. While we aim to provide prompt responses to all requests, AxePoint will respond within forty-five (45) days from the initial request.
If you think that the processing of your Personal Data is not in compliance with data protection laws, you have the right to make a complaint about AxePoint to the appropriate authorities. We encourage you to contact us at info@axepoint.com before raising a concern with the supervising authority, to see if we can resolve any concerns you have about our processing of your Personal Data.
H. Children’s Online Privacy Protection
Protecting the privacy of children is especially important to us. We may collect information of minors under the age of 13 with parental or guardian consent. Information of minors that is collected and stored may include name, address, email address, and phone number. The personal information will be used to provide services to the minor. Personal information of minors will not be disclosed to third parties.
NOTICE TO PARENTS/GUARDIANS
If we learn we have collected or received information from a child under the age of 13, without verification of parental or guardian consent, we will delete that information immediately upon discovery.
I. Third-Party Services
Our Site may contain links to third-party websites or services, such as third-party integrations, co-branded services, or third party-branded services (“Third-Party Services”). AxePoint doesn’t own or control these Third-Party Services. We reserve the right to update this Privacy Policy from time to time by publishing a new version directly to the Site.
